1. Acceptance of Terms

By accessing or using BitePass (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a school or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

BitePass is a school meal management platform that provides meal selection, QR-based attendance tracking, budget analytics, and parent visibility tools. The Service is available as a Progressive Web App (PWA) accessible through web browsers on any device.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • School administrators are responsible for managing and inviting users within their institution
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You may not share your account credentials with others

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service without written permission
  • Misrepresent your identity or affiliation with any person or organization
  • Upload or transmit harmful code, viruses, or malicious software

5. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, software, and design — are the exclusive property of BitePass and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

School administrators retain ownership of their institution's data and may request deletion at any time by contacting us.

7. Fees and Payment

BitePass currently operates during its beta period and may offer free or discounted access. We reserve the right to introduce paid plans at any time. If fees apply, they will be clearly communicated before any charges are incurred. All fees are non-refundable unless otherwise stated.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of scheduled downtime.

9. Limitation of Liability

To the maximum extent permitted by law, BitePass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or uninterrupted.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for a reasonable period following termination.

12. Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of the applicable jurisdiction.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
